03. Victims of air accidents and relatives of victims

Who have the status of victims or relatives of victims on civil aviation accidents?

Royal Decree 632/2013, of August 2, assistance to victims of civil aviation accidents and their families and amending Royal Decree 389/1998, of March 13, states the following regarding the definition of victims and their relatives:

Victim: 'Everyone, occupant of the aircraft or not, who is involuntarily involved directly in a plane crash. They may be victims of an accident the crew, passengers or occupants of the aircraft and others. '

Relatives of the victims: 'their spouse or partner, ascendants and descendants by blood or marriage, and collateral relatives within the second degree.'

What information can get victims and their relatives about the investigation?

The Office of Victim Assistance (Ministry of Public Works) provides information to victims and their relatives on various issues related to the accident. Notwithstanding the foregoing, the CIAIAC can provide, according to the applicable regulations, a copy of the final report prior to its publication, for which they must apply through the link 'Prior notification of publications' (Notificación previa de publicaciones) on the CIAIAC website upon identification.
